Terms of Service

The rules for using Recruity

These terms describe the service, your responsibilities as an email sender, and the limits that keep the contact bank useful and lawful.

1. Accepting these terms

These Terms of Service are an agreement between you and Recruity (“Recruity,” “we,” or “us”), a business based in Ontario, Canada. By creating an account, accessing the contact bank, or using the service, you agree to these terms. You must be at least 18 years old and able to enter into a binding agreement.

2. What Recruity provides

Recruity helps users find professional recruiters and hiring managers, prepare personalized outreach, and send user-approved messages through a connected mailbox. AI-generated content is provided as a draft. You are responsible for reviewing and approving every message before it is sent.

3. Where contact information comes from

The professional contacts in our bank are purchased or licensed from third-party data providers. Those providers compile business information from sources such as public professional profiles, company websites, business directories, public records, and their own contributors or partners. A record may include a person’s name, job title, employer, professional profile, and work email address. We do not promise that every record is current, complete, or suitable for your intended use.

4. Your outreach responsibilities

Purchasing, licensing, listing, or revealing a contact does not by itself mean that the person has consented to receive your email. You are the sender and are responsible for ensuring every message complies with Canada’s Anti-Spam Legislation (“CASL”), privacy laws, and any other law that applies to you or the recipient. This includes having a valid form of consent or other lawful basis when required, accurately identifying yourself and any organization you represent, providing valid contact information, using honest subject lines, and including and promptly honouring a working unsubscribe method.

5. Acceptable use

You may use the service only for lawful, relevant professional outreach. You may not use it to harass, deceive, discriminate, impersonate others, send malware, violate a person’s opt-out request, or run indiscriminate spam campaigns. You may not scrape, export, resell, publish, or build a competing database from the contact bank; bypass sending or reveal limits; probe the service; or interfere with another user. We may restrict or suspend activity that creates legal, security, deliverability, or reputation risk.

6. Accounts and connected services

You are responsible for your account, its security, and activity performed through it. You authorize us to interact with connected email and authentication providers only as needed to provide features you request. Third-party services have their own terms and privacy practices, and we are not responsible for their availability or conduct.

7. Plans, billing, and cancellation

Paid plans are billed in Canadian dollars unless checkout states otherwise. Prices, taxes, limits, and renewal terms are shown before purchase. Subscriptions renew automatically until cancelled. You may cancel future renewals through the billing portal; cancellation takes effect at the end of the current paid period. Except where required by law, fees already paid are non-refundable.

8. Ownership and licence

Recruity and its licensors own the service, software, design, and contact-bank compilation. We give you a limited, personal, revocable, non-transferable licence to use the service under these terms. You keep ownership of content you submit and give us permission to process it only as needed to operate, secure, and improve the service.

9. Disclaimers

The service and contact information are provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not guarantee replies, interviews, employment, deliverability, or legal compliance from using a contact record.

10. Limitation of liability

To the fullest extent permitted by law, Recruity will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or emails. Our total liability for claims relating to the service will not exceed the greater of CAD $100 and the amount you paid Recruity during the 12 months before the event giving rise to the claim. These limits do not apply where the law does not permit them.

11. Ending use and changes

You may stop using the service at any time. We may suspend or terminate access for a breach, unlawful conduct, non-payment, security threat, or material risk to Recruity or others. We may update these terms and will post the new date here. If a change is material, we will provide reasonable notice where required. Continued use after the change takes effect means you accept the revised terms.

12. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to rights you cannot waive, the courts located in Ontario will have exclusive jurisdiction over disputes relating to these terms or the service.

Privacy Policy

How we handle information

This policy covers information about Recruity users as well as professional information belonging to people listed in the contact bank.

1. Scope and accountability

This Privacy Policy explains how Recruity collects, uses, shares, and protects personal information when you use our website and service, and how we handle professional contact information in our contact bank. Recruity is based in Ontario, Canada and handles personal information in accordance with applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (“PIPEDA”).

2. Information we collect

We may collect account and profile details, such as your name, email address, professional profile, resume, preferences, and authentication identifiers; billing status and transaction references; campaign recipients, message drafts, approvals, sending status, and replies or engagement events; information needed to connect your mailbox; support messages; and technical data such as IP address, device, browser, logs, and cookie data. Payment card details are processed by our payment provider and are not stored by Recruity.

3. The professional contact bank

We purchase or license business contact records from third-party data suppliers. These records may include a person’s name, employer, title, location, professional profile URL, and work email address. Suppliers may obtain that information from public professional and company sources, public records, directories, contributors, and partners. We use this data to organize and provide a searchable professional contact bank, verify and update records, prevent misuse, and respond to correction, access, or removal requests. We do not intend the bank to contain sensitive personal information or private, non-business email addresses.

4. How we use information

We use personal information to create and secure accounts; provide search, drafting, sending, billing, and support features; connect services you authorize; personalize and improve the product; monitor reliability, abuse, fraud, and deliverability; enforce our terms; comply with law; and communicate with you about the service. We do not allow fully automatic sending without the user’s approval.

5. Consent and lawful outreach

Recruity’s possession of a professional contact record does not establish consent for every user or every message. Users must independently determine whether they have express consent, implied consent, or another lawful basis for their specific outreach, and must satisfy CASL and other applicable requirements. Recipients may ask a sender to unsubscribe and may also contact us to request that a contact-bank record be reviewed, corrected, or removed.

6. When we share information

We share information only as needed with vendors that help us provide hosting, databases, authentication, email delivery, payment processing, analytics, security, and customer support; with services you choose to connect; during a financing, merger, acquisition, or sale subject to appropriate safeguards; or when required to comply with law, protect rights and safety, or investigate misuse. Vendors may process information only for the services they provide to us. We do not sell our users’ account information.

7. Processing outside Canada

Some service providers may process or store information outside Ontario or Canada, including in the United States. Information in another country may be accessible to courts, law enforcement, or national-security authorities under that country’s laws. We use contractual and technical safeguards appropriate to the information and provider.

8. Retention and security

We keep personal information only as long as reasonably needed for the purposes described here, to provide your account, resolve disputes, enforce agreements, and meet legal obligations. Retention periods vary by data type. We use administrative, technical, and physical safeguards designed for the sensitivity of the information. No internet or storage system is completely secure, so we cannot guarantee absolute security.

9. Your choices and privacy rights

You may ask to access or correct personal information we hold about you, withdraw consent where applicable, close your account, or request deletion, subject to legal and technical limits. If you appear in the professional contact bank, you may ask us to identify the information we hold, correct an inaccurate record, or remove or suppress it from future use. We may need to verify your identity before completing a request and may retain a minimal suppression record so removed information is not added again.

10. Cookies, children, and updates

We use essential cookies and similar technology for login, security, preferences, and service operation, and may use limited analytics to understand performance. The service is not directed to anyone under 18, and we do not knowingly collect children’s personal information. We may update this policy as our practices or laws change. We will post the revised date and provide additional notice when required.
